By using GamerSpots.com you agree to abide by our terms and conditions set forth:

Membership: There are two types of member accounts; Personal and Business.

a) Personal: Personal accounts are free and offer the opportunity for members to submit GamerSpots, Review GamerSpots, Comment on GamerSpots and Post Photos of GamerSpots. GamerSpots grants permission of personal members to use our service to accurately inform others about local GamerSpots. In creating a personal account we ask for you to provide complete and accurate information. As a personal member you agree not to use GamerSpots for commercial purposes. You agree to not provide any information that is not your own and you agree not to impersonate others.

b) Business: Business accounts are for business owners only. This membership runs $30/Month. Business members have additional opportunities to promote their business to our personal members through expanded listings, website links, additional photos, movies and ability to advertise specials and post coupon codes that can be redeemed in-store by our personal members. Business owners can also interact with personal members and reply to comments posted by personal members.

Content: GamerSpots is member supported so all business locations, reviews, photos and comments are posted exclusively by our members. Members take sole responsibility for their content and may expose themselves to liability if their posted content violates any 3rd party rights including any copyright, trademark or patent infringement. Reviews and comments, whether positive or negative, must be accurate and not include any false or defamatory content.

Use of Content: Once content is posted on GamerSpots, GamerSpots reserves the right to utilize member content, including reviews, comments and photos in advertising or promotion of GamerSpots.com. Members will not receive any monetary compensation for GamerSpots use of their content. GamerSpots reserves the right to edit, remove or screen user content at our sole discretion and without notice to members.

Intermediary: GamerSpots acts only as an intermediary and has no knowledge of the reputation or business practices of any of the establishments herein nor does GamerSpots warrantee, in any way, goods or services bought or sold from these establishments. GamerSpots make no claims or promises about the quality, accuracy or reliability of the business listings, reviews, comments or rankings posted by our members. Use of the GamerSpots service is at your own risk.

Interruption of Service: GamerSpots has taken reasonable and prudent precautions consistent with the current state of internet technology to protect against service interruption and/or data loss and assumes no responsibility for damages of any kind due to such interruption or loss for any reason.

Security: GamerSpots has taken reasonable and prudent precautions consistent with the current state of internet technology to protect the security of all data stored on the GamerSpots system. While these precautions make it highly unlikely that unauthorized access will occur, GamerSpots bears no responsibility and will pay no damages for any problems associated with any unauthorized access by third parties. If such cases do occur, GamerSpots will alert and cooperate with law enforcement agencies, including the sharing of data relating to the unauthorized incursion, such as, but not limited to the sharing of log files, etc., in order to eliminate the source of the incursion.

Privacy: Registration data provided to GamerSpots by members will be used solely for the stated purpose for which the data was collected. No user registration data will be sold or given to any organizations wishing to use it for marketing or any other purpose UNLESS THE MEMBER GIVES EXPRESS PERMISSION IN ADVANCE, which would clearly be stipulated and solicited by GamerSpots.

Breach: GamerSpots may, without prior notice, limit your activity, temporarily or indefinitely suspend or terminate your membership and refuse to provide our services to you if: (a) you breach this Agreement or other policy documents and community guidelines this Terms of Use incorporates by reference; (b) GamerSpots is unable to verify or authenticate any of your information.

NO WARRANTY: GAMERSPOTS, GAMERSPOTS PARENT, SUBSIDIARIES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES PROVIDE GAMERSPOT’S WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY.

LIMITATION OF LIABILITY: IN NO EVENT GAMERSPOTS, AND (AS APPLICABLE) GAMERSPOTS PARENT, SUBSIDIARIES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES WILL BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

INDEMNIFICATION: YOU AGREE TO INDEMNIFY AND HOLD GAMERSPOTS AND (AS APPLICABLE) GAMERSPOTS PARENT, SUBSIDIARIES, PARTNERS, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.
